DATA PROTECTION PRIVACY NOTICE

for Website users, Job applicants, and potential Programme Contributors

Introduction

We are a UK based television production company and it is important to us to explain to you how we use the information we collect about you when you use our website.  

In processing the personal data you give us when you use our website the Company acts as a ‘data controller’. The Company will collect, process and retain any personal information collected from you when you use our website, or when you provide us with personal information through our website, in accordance with all laws and regulations relating to the protection of personal data including the General Data Protection Regulation ((EU) 2016/679) (“GDPR”), the UK’s Data Protection Regulations 2018 (as amended) and the Data (Use and Access) Act 2025.

In this privacy notice we explain the type of information we process, why we process it and how that processing may affect you.  

In this notice, any reference to “we”, “us” and “our” is to Three Arrows Media Limited and any associated companies. We are a company registered in England and Wales (company number 9915950) with its registered office at 79 Hope Road, Sale, M33 3AW

References to “work” or “services” (and similar expressions) include any arrangement we may have with an individual who provides us services in relation to a production or programme. We also use the word “you” to refer to anyone within the scope of this notice.

References to “Programme” or “Production” includes the development of the programme, the programme itself and/or series you have applied for, or been approached to appear in; and any re-edited, re-voiced, re-formatted, updated or compilation, or any other versions of the programme, or further series or spin-off’s and/or other content.

What is ‘Personal Data’ and ‘Processing’?

Personal data” is information relating to you which is processed by a computer/other device or a manual filing system. It includes facts about you, but also may include intentions and opinions about you.  It also includes any data derived from equipment such as building access passes and sound and image data such as CCTV. It also covers video, audio and images captured as part of a production.

Processing” means doing anything with the data.  For example, it includes us collecting it, holding it, disclosing it and deleting it.

Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, health, sexual orientation, sex life, trade union membership and genetic and biometric data are subject to special protection and considered by data privacy law to be “special category data”.

What information do we collect about you?

What information we collect about you depends on the way you decide to interact with us.

As a website user:

If you decide to visit and use our website, https://www.threearrowsmedia.com/, we may collect information about your computer and about your visit (including your IP address and geographical location and any other information that you may choose to send us).

As a Job Applicant:

If you use our website to apply for any vacancies we may have and you provide personal information (for example: name, e-mail, phone number, address; employment, salary and qualification details on a CV or application form) you consent to Three Arrows Media using your information for the purposes of your application and as part of the recruitment process.

If you send us an un-solicited CV (not in connection with any specific recruitment process) then we are likely to retain your CV for future recruitment to suitable vacancies, unless we tell you otherwise.

As a potential Programme Contributor:

If you decide to apply to be a Contributor on (or participate in) any of the programmes we intend to produce, we may ask you to provide us with personal information which may include your name, address, postcode, email address, date of birth and telephone number.

If you are under 18 years of age we will need your parents/guardian’s permission before you provide us with any personal information.

As a Job Applicant and potential Programme Contributor:

Depending on the nature of the job or programme, we may also ask you to provide us with special category data (see above). This is only collected where it is absolutely necessary and appropriate to do so. We will only collect this where one of the grounds for processing mentioned below applies (‘How do we use this information’), and when one or more of the grounds for processing sensitive personal/special category data applies, which include:

  • Where you have given explicit consent to the processing of your special category personal data;
  • Or this data has already been made public by you (e.g. if you tell us you are ill);
  • Or processing is necessary for the purpose of establishing, making or defending legal claims;
  • Or Processing is necessary for provision of health care or treatment, medical diagnosis, and assessment of your working capacity;
  • Or processing for equality and diversity purposes is necessary, to the extent permitted by law.

In addition (this list cannot be exhaustive):

  • We may also conduct background checks to verify personal information about you and assess your suitability for a job or to take part in the Programme.  This may include us taking references, making identity checks or other background checks, checking publicly available directories/sources/social media platforms, checking with tax authorities/governmental bodies/detection agencies/ fraud prevention.
  • We may also require criminal background checks for certain roles or we may ask you to self-declare any criminal convictions or offences.  Where we require criminal background checks (from the Disclosure and Barring Service) we rely on the legal basis that it is necessary to comply with statutory or regulatory requirements or obligations and we are entitled to carry out these checks in order to satisfy ourselves that there is nothing in your history which makes you unsuitable for the job or programme.
  • If relevant, we may also process information about your health and any disability you have, in case we need to make any adjustments to your working environment/filming arrangements.
  • If relevant (for potential Programme Contributors) we will evaluate your potential role on a production by processing images/video/audio taken of you.
  • We are likely to ask you for details of your emergency contacts.
  • In order to monitor diversity and equal opportunities we will ask you for personal data such as your nationality, racial and ethnic origin, gender, sexual orientation, religion, disability and age. Such data will be aggregated (not personalised) and used for equality of opportunity monitoring purposes. We are required to share aggregated and anonymised diversity statistics with regulators and commissioners under the ‘Diamond’ project, the system managed by the Creative Diversity Network, on behalf of the UK Broadcasters BBC, ITV, Channel 4, Sky and Channel 5/Viacom.

If we ask you about sensitive information (e.g. criminal convictions or your health information) you do not need to provide this information to us, however if you do not, you may be unable to apply for a job or take part in a programme.

How do we use this information?

As a website user:

Information we collect about you when you visit and use our website will be used by us to ensure our website is presented in the most effective way for you and your computer.

Cookies for website users

A cookie is a small file of letters and numbers that we put on your computer’s hard drive to track, save and store information about the user’s interaction and usage of our website. This helps us analyse data about webpage traffic and improve our website in order to tailor it to our visitors’ needs.

A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

You can choose to accept or decline cookies. You can decline cookies if you prefer but this may prevent you from taking full advantage of our website.

As a Job Applicant or potential Programme Contributor:

If you provide us with personal information and we use your information, we make sure that such use complies with the law, which allows us to use personal data for a variety of reasons. These include (‘the Legal Grounds for processing your personal data’):

  • in order to perform our contractual obligations with you, and with our clients, customers and suppliers;
  • where we have obtained your explicit consent;
  • in order to discharge our legal and regulatory obligations, including complying with Health and Safety laws and ensuring there is no unlawful discrimination against you;
  • in order to establish, exercise or defend our legal rights or for the purpose of legal proceedings;
  • as is necessary for our legitimate business interests (as long as these do not override your own rights and freedoms), such as:

    • allowing us to effectively and efficiently manage and administer the operation of our business (being the development, production and distribution of television programmes);
    • maintaining compliance with internal policies and procedures; and
    • monitoring the use of our intellectual property.

If you are a potential Programme Contributor there may be occasions when we or third parties will rely upon exemptions to data protection rules in relation to journalistic freedom, the right to artistic expression or more generally, the right to freedom of expression (as mentioned in article 85 of the General Data Protection Regulation and in the UK’s Data Protection Bill section on the exemption for ‘journalistic, academic, artistic or literary purposes)’.

Who gets to see your Data?

The personal data you provide us may be disclosed within the Company to our staff working on the production, and to any staff who need this information to fulfil their job.

From time to time we may be required to transfer your Personal Data to external third parties contracted by or on behalf of Three Arrows Media to perform certain employment-related or other business-related services (for example Contributors’ details may be used for distribution and marketing purposes and passed onto relevant bodies such as the Commissioning Broadcaster). Or we may need to disclose certain Personal Data to certain third parties where we are required to do so by the laws of the relevant jurisdiction or to any competent regulatory or governmental body or authority.  

Any Companies or organisations and/or individuals with whom we share your Data will be required to comply with current Data Protection laws.

We may also need to send your personal information outside of the UK and European Economic Area (‘EEA’) to our agents or advisors to fulfil our business activities.  If we do transfer your personal information outside of the UK or EEA, we will make sure that the transfer is lawful and that the recipients protect your information to the same standards as if it was being used in the UK.

The Company does not use automated decision-making during our recruitment processes.

Data storage and retention

As a Job Applicant or potential Programme Contributor:

Your data will be stored in a range of places within the Company if you are a job applicant or potential Contributor, in paper files or on IT management and email systems.

We keep your personal data for as long as it is required by us for our legitimate business purposes, to perform our contractual obligations, or where longer, for such longer period as is required by law or regulatory obligations which apply to us.  

If you work for us as staff or as a Programme Contributor then we will keep your data for as long as you work with us and for a period afterwards (Staff who are employed by us will receive a separate Staff Data Protection Privacy Notice on joining the Company).  If you are a potential Programme Contributor who is not chosen to take part in a programme then we will only retain your personal data for a short period of time after our discussions have ended.

The company takes the security of your data seriously. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our staff and the relevant third parties in the proper performance of their duties.

Accessing your information

As a Job Applicant or potential Programme Contributor:

You have rights when it comes to how we handle the personal information you give us. These rights include:

  • The right to be informed about the data we hold about you;
  • The right of access to the data we hold about you;
  • The right to rectification of incorrect or incomplete data we hold about you;
  • The right to erasure of the data we hold about you;
  • The right to restrict processing if the data is no longer necessary;
  • The right to data portability;
  • The right to object to processing of your data;
  • Rights in relation to automated decision making and profiling.

If you would like a copy of some or all of the personal information that we hold about you (a Subject Access Request) please contact us directly using the contact details below.

There will not be a charge for handling a request to exercise your rights.

We will carry out a ‘reasonable and proportionate’ search for your data based on the context of your request and our available resources.  We are required to provide you with this information within a month unless your request is complex and we ask you to clarify your request.

If you are unhappy about the way in which your information has been handled by Three Arrows Media you can contact the ICO at www.ico.org.uk/concerns.

From 19th June 2006 there will be a new ‘right to complain’ and after this date you must complain to Three Arrows Media first, before approaching the ICO.  The ICO will provide guidance on the new right before June 2026.
